Title: Bloody Bank Charges!!! Post by: scotty2hatty on December 27, 2007, 06:10:55 PM FFS! A transaction of £5.38 took me over my agreed overdraft and now the Bank of Scotland have decided to charge me £20 aswell as a £28 monthly Unauthorised Overdraft Charge.
They are coming off on the 4th and 31st of January - I'm not paying it - £48 for less than a fiver overdrawn. Farce. Anyone else experienced this? Manage to resolve it? Title: Re: Bloody Bank Charges!!! Post by: M3boy on December 27, 2007, 07:21:19 PM Write to them.
You should get a refund. Title: Re: Bloody Bank Charges!!! Post by: dan on December 27, 2007, 07:37:11 PM The banks are going to court at the moment about their charges, all the high street banks have since restructered their charges since this court case started. Now they charge an unplanned overdraft charge as this is now seen ( by the bank ) as a service rather than a penalty ( which is unlawful ).
My mum recently went overdrawn for the 1st time in years after her pension was wrongly stopped from going into her account. I went into the branch with her and asked to speak to her account manager. I explained the situation and they reversed the charges. So if this is your 1st time for years that you have gone over your limit then try this approach. I dont advise writing to them as the FSA and the FOS agreed a 12 month waiver on the 28th July 2007 where the banks do not have to deal with bank charge claims. Title: Re: Bloody Bank Charges!!! Post by: scotty2hatty on December 27, 2007, 08:54:06 PM Thanks for the replies. Was thinking of writing a letter as I'm no good at face to face combat, but it seems i should go in and speak to them. £48 is just excessive imo.
Why don't debit cards just refuse the transaction? Title: Re: Bloody Bank Charges!!! Letters to reclaim bank charges as Unlawfull are a waste of time, for the reasons you say above. BUT - for one off charges, a letter to the bank explaining the situation ususally gets the charge refunded. Title: Re: Bloody Bank Charges!!! I still have the same natwest account, and have suffered similar sitiations to the OP - twice. - This is AFTER the claim above 2 letters written and got both back within a few days :) Title: Re: Bloody Bank Charges!!! It is illegal for a bank to take charges you cannot afford and they will refund everytime! Title: Re: Bloody Bank Charges!!! Post by: M3boy on December 28, 2007, 01:57:16 AM It is illegal for a bank to take charges you cannot afford and they will refund everytime! A VERY bold statement to say the least! Isnt that what the test case is all about? But I do know it is illegal to write a cheque WITHOUT having cleared funds. Title: Re: Bloody Bank Charges!!! I can write a cheque legally with nothing in my account up to the amount on my "cheque guarantee card" cuz it's a "cheque guarantee card" :D Title: Re: Bloody Bank Charges!!! Post by: M3boy on December 28, 2007, 02:30:27 AM No, the test case is about the legality of the charges.
What will happen is that "all" accounts will come with an "administration charge" - this will probably be montly. The banks will set this at such a rate as to "cover" the amount they used to collect in bounced cheque and DD charges, so in effect, the people who operate their accounts well will be paying for those who do not. Just my humble opinion Title: Re: Bloody Bank Charges!!! Proving it wasn't a mistake might be hard for the banks but i wouldn't try it very often if i was you. Sandy Title: Re: Bloody Bank Charges!!!
