Title: Help Please!!!!!!!!!! Post by: Ismene on January 12, 2009, 11:44:08 AM Hi Guys
Very quick question - Is there a law that someone can either point me in the direction of or provide me with the article which states that no governing body can remove the tools of ones trade? I have a vague recollection of something like that in the Magna Carta - but my googling is not proving profitable.... I have a very officious neighbour who is proving to be incredibly difficult and making complaints left right and centre, who i need to shut down in a hurry. Many thanks A Title: Re: Help Please!!!!!!!!!! Post by: HOLDorFOLD on January 12, 2009, 12:32:11 PM Not sure about all governing bodies - but the bailiffs guide is this
Are there any goods that the bailiff cannot seize? Bailiffs (except bailiffs acting on behalf of the magistrate's court - see below) cannot seize the following goods: * tools, goods, vehicles and other items of equipment necessary for use by you in your employment, business or vocation; * clothing, bedding, furniture, household equipment and provisions as are necessary for satisfying the basic domestic needs of you and your family Bailiffs acting on behalf of the magistrates' court cannot seize the following goods: * clothing, beds and bedding tools of the trade * basic domestic needs of the family would normally include fridge, cookers, freezers, but may not include video recorders, second TV's, jewellery, washing machines, stereos or microwave cookers. found on website: http://www.insolvencyhelpline.co.uk/debt_basics/bailiff-guide.php#bg11 Title: Re: Help Please!!!!!!!!!! I've only been moved in for about a month - and had Sky for less - and already a complaint has been made that my dish is on the front of the house (the only place to get reception). Since i require it for work, i now have to present a compelling argument to get planning permission.... sigh - I wish i knew who it was! Title: Re: Help Please!!!!!!!!!! Post by: Jon MW on January 12, 2009, 01:16:01 PM Is it a listed building?
Because that's the only reason I was aware of that you'd need to get planning permission. Title: Re: Help Please!!!!!!!!!! Post by: Acidmouse on January 12, 2009, 01:20:21 PM lol planning permison for dish? thats a new one to me.
Title: Re: Help Please!!!!!!!!!! Post by: Ismene on January 12, 2009, 01:22:46 PM Apparently i have moved into a conservation area FML - with neighbours who are ready and willing to throw the rule book at every opportunity....
FFS why can't people get a life Title: Re: Help Please!!!!!!!!!! Post by: Colchester Kev on January 12, 2009, 01:23:27 PM A lot of new developments have contractual clauses forbidding the installation of sat dishes and other weird clauses.
Title: Re: Help Please!!!!!!!!!! Post by: Ismene on January 12, 2009, 01:29:19 PM Zero clauses - it's one of the main things i check before buying a place.
I must have failed to read the small print..... I am allowed a satellite dish - just not on the front apparently..... Since this is the only place where reception can be achieved - I'm up the creek..... Title: Re: Help Please!!!!!!!!!! Post by: cia260895 on January 12, 2009, 01:42:11 PM house or flat?
Title: Re: Help Please!!!!!!!!!! Post by: AndrewT on January 12, 2009, 01:47:42 PM Zero clauses - it's one of the main things i check before buying a place. I must have failed to read the small print..... I am allowed a satellite dish - just not on the front apparently..... Since this is the only place where reception can be achieved - I'm up the creek..... Sounds like they knew which side the dish had to go when they drew it up. I suspect that, seeing as you signed a thing saying you can't put a dish on the front of the house, and then you did that, it's end of story - the dish has to come down. Title: Re: Help Please!!!!!!!!!! Post by: Laxie on January 12, 2009, 01:49:32 PM Or they could use a really tall pole from the back going up high enough to get the same reception. They do it here all the time.

Post by: totalise on January 12, 2009, 01:55:41 PM I read this on another forum , not sure if its real or if its a load of bs, but its worth looking at I guess
"My friend wanted to install a Sky minidish at the back of his house in a conservation area in Cumbria where there is currently no Freeview signal. He took a photo of the back of his house and "Photoshopped" a Sky minidish onto the wall, "painting" it the same colours as the stonework, camouflage style. He took the photo printout to the local Planning Department and explained what he proposed to do (most important). The planning department then inspected his property and gave him the go-ahead. I think what really swung it was his offer to fit a quad-output LNB and feed his neighbour's house as well. Apparently he'd got the whole idea from the eBook "Installing Sky Digital". The installed dish was duly inspected and approved. The planning officer and local councillor commented on how nicely he'd done the camouflage paint." Title: Re: Help Please!!!!!!!!!! Post by: Rod Paradise on January 12, 2009, 01:56:19 PM My flat is in a conservation area as well - so all the sat dishes go on the roof & cables dangle down the outside of the building. Sky won't do that part of the installation though.
Title: Re: Help Please!!!!!!!!!! Post by: DaveShoelace on January 12, 2009, 02:01:47 PM Just pay some hoodies to hang around your neighbors houses, they'll soon have something new to complain about instead.
Title: Re: Help Please!!!!!!!!!! Post by: Woodsey on January 12, 2009, 02:06:41 PM I had same problem. You just have to put it somewhere out of sight. I had it on chimney on the back roof at top of house just out of sight when looking from front of house, or you could put it up in the Garden somewhere. You will have to pay Sky extra because its a non-standard installation though.

I haven't signed anything - there is no "small print" as such - just council regulations. What irritates most is i phoned them and asked if i would be able to have a satellite dish prior to purchasing the property and was told yes... Obviously as you can have it on the back - no one said anything about having to get planning permission if i need it on the front. I have already tried the chimney idea and unfortunately not even that can get reception..... SIGH Title: Re: Help Please!!!!!!!!!! Post by: Jon MW on January 12, 2009, 03:19:55 PM How enforceable is it then? (this may be a question to ask a lawyer)
Could you just ignore them? Title: Re: Help Please!!!!!!!!!! Post by: Ismene on January 12, 2009, 03:31:24 PM How enforceable is it then? (this may be a question to ask a lawyer) Could you just ignore them? Dunno Hint hint Robert ;) TBH i think i can most likely push it through under the planning permission - it's just a case of having to shell out £150 to apply which I am loath to do - But they will most likely wear me down with their ridiculous time frames . SIGH When I was travelling I used to take my sky dish with me and bolt it to an old car wheel to hold it upright. Then it was just a case of pointing it in the right direction. I can't understand why one fixed to the chimney wouldn't work. Title: Re: Help Please!!!!!!!!!! Post by: Robert HM on January 12, 2009, 04:02:53 PM How enforceable is it then? If it's in breach of planning regs they can issue an enforcement notice telling you to take it down, if you don't comply it can end up in a Magistrates' Court. Title: Re: Help Please!!!!!!!!!! Post by: kinboshi on January 12, 2009, 04:20:31 PM Can you get cable? (which is obviously the enemy)
Title: Re: Help Please!!!!!!!!!! Post by: Ismene on January 12, 2009, 05:42:50 PM Lol no - the entire area is bereft of cable so that's a no go.
There is a tree which effectively blocks all signalto the house, bar where the dish is currently situated. Looks like i'll have to shell out the £150 then going on what Robert said.... Sigh TY chaps - guess sometimes you have to bite the bullet Title: Re: Help Please!!!!!!!!!! http://www.sqish.co.uk/ The second one refers to conservation areas (subject to regulations) - don't know the regulations. |
