Title: being sued...
Post by: lazaroonie on January 13, 2009, 02:19:59 PM
this may only apply to scottish law, but opinions welcome....

anyway, I being pursued for an amount of money. I dont actually dispute that an amount is owed, what I do dispute is the amount being claimed, and how that amount has been reached.

I wrote to the other parties solicitors saying as much, and making an offer, without prejudice, in full and final settlement. they rejected this offer, and now we have a court date. Anyway, so now I receive a letter from the (their) solicitors informing me of the court date. Where it gets interesting is they are wanting me to advise them as to what my defence will be in this matter. should I tell them ? am I duty bound to tell them ?

seems a bit strange to me.

I have no idea, but I'd definitely recommend getting decent legal advice before you go any further.
