This thread replaces my old diary. Please feel to ask me any questions on DTD here.

I've been to the club today, I visit the premises at least once per week. There is still some snagging to do and I'm not too sure about the poker table and chair colours that our designer has chosen, but Nick told me they are already ordered when I moaned, so I guess I'll have to like it or lump it. We have 2 different "cycodelic" colours and the chairs are all going to mixed in, I think our designer wants DTD to look a bit "hip", versus the tradional card room look.

DTD staff have now fully reloated from above my pub to new offices on Pheonix Park, next door the sf group offices. We have 45 desks and even a canteen area, its a bit bigger than we need, but the DTD staff are appreciating the air conditioning, my only concern is that the sales in the pub may go down as DTD staff were good for at least £200 per week!

Michelle Hill, ex Marketing Manaager at sf group has moved over to work at DTD, and Lindsey Raven has joined as Financial Controller, she is also ex sf group. Rather than recruit new staff for DTD, I have chosen to move accross some of my trusted employees at sf group and replace them in that business (which is easier to do as it is already set up and has procedures/policies in place). Even though there is uncertainly over the future of DTD, I will not stop developing the organisation.

The main news on the hearing is that I have made the following offer in writing last week to the 3 objectors, London Clubs, Stanleys & Gala Casinos (through their lawyers of course)

Dear Sirs
 
I confirm that Dusk till Dawn Limited would be prepared to agree and sign a legally binding document with London Clubs International, Stanley Casinos Limited and Gala Coral Group Limited.   

The agreement would prohibit Dusk till Dawn offering Casino games to its members and guests and would also bind any future owners of the poker club.   

The agreement would provide for damages should there be any breach.   

Dusk Till Dawn Ltd would be prepared to sign such an agreement subject to the agreement being accepted by all three objectors.

The possibility of this happening is already zero. Although London Clubs agreed to it (genuine thanks to them), Gala Casinos ingored it, and Stanley Casinos wrote back declining my offer. This shows us that the casinos concern over us having table games is not the reason why they are opposing the club, it about poker being conducted outside of a casino environment, simple as that.

Never mind, I tried my best.

I have read your post ever since i joined, and I hope to god that the law/courts dont turn out to be an ass, u deserve this and the poker playing public deserve this..

The pictures look good, I cant wait to see the place, will have to make the long journey down when it opens, i'm sure it will be worth it..

Thanks, but every comment has been put forward as evidence, which the magistrates will see, everyone has done their best, I do not believe there is anything more any of us can do, including me, its down to the courts now, we just have to wait for 5 more weeks, and things will be decided, one way or another. Our evidence is nothing short of overwhelming, I cannot think of any reason why we will not be successful. My letter to the casinos offering to sign the legally binding agreement has also been sent with our evidence, its a cut and dry case.

I certainley hope the court looks into the complete background of this case, and realises all the hard work, time and effort put in to trying to get a legitmate business up and running.

I hope its not a case of they feel "dictated" to by the "big boys" and just roll over.

I have never met Mr Yong, in fact all i know about him is what I have read on here, but i feel he has been honest and open with everybody from the word go, and for that i wish him every success for the future.

Many a "lesser man" would have given up long ago with all the problems he has had to face, try and overcome.

No Boldie, LCI would withdraw their objection BUT Gala and Stanley would still which effectively still means long draw out hearing. 2 or 3 objectors will make little difference unfortunatley. I made the offer to all 3 objectors, so the casinos collectively could be reassured that Dusk Till Dawn would not compete with their "core business" and even if Dusk Till Dawn Club was sold to another casino group (which I have no intention of going) the new owners could not operate blackjack, roulette etc.

It proves that they have a problem with POKER being operated outside of their walls, which I suppose indicates the revenues that they must make on the table games from poker players is significant.

maybe a "shrewder businessman" would have pulled out, but I don't appreciate getting pushed around by faceless greedy corporates who only care about profits, especially on my own doorstep. I have never moved more than 1 mile from where I was born, Nottingham has been good to me, and I will continue to do everything I can to create jobs and work in this city. The casinos expected me to just "crawl away", not a chance.

Oh, I see, I thought you meant clubs based in London had accepted the deal.Thought that sounded odd.

Yep, fair dos, that was big of them - shame Gala and Stanley can't follow suit though. LCI obviously don't make as much from the poker players as the latter two do.

Regardless of what the revenues generated from poker and poker players playing casino games the big corporates just hate the idea that the loss of 1 punter let alone hundreds of punters will make a big dent in their bottom line. The refurb at the vic shows that Grosvenor now realise that its better to have a full cardroom upstairs as opposed to 15 or however many high roller casino tables they used to have upstairs that were constantly lying empty with the occassional punter and yet they had to keep them staffed in case a high roller walked in, it goes back to the old saying that 10% of £1000 is far better than 50% of £0. The days of the high rollers and casinos milking it in are gone and most of them have realised that they can make a profit from poker and since it has become so popular in recent years they just want to keep their own little closed shop as regards to legal card rooms.

Just out of interest Rob, when LCI applied for their license in Nottingham were there any objections from any of the other casino groups?

PS Good luck in court and lets hope the magistrates see sense and do the right thing and allow someone who has been vetted by the gaming commission and gone through everything you have done to toe the line to legally open a licensed poker room as its definetely for the good of the game in this country.

I went to Stanley's new Casino in Nottingham a couple of nights ago, they all seems a nice bunch over there, and quite a few are ex gala employees as I guess you would expect, now there is an alternative casino employer in Nottingham. The Duty Manager noticed me speaking to one of dealers and came accross........but only to wish me all the best on the poker club, what a nice gesture, I think he realises that Dusk Till Dawn will actually bring in business to Nottingham, not steal from the casinos.

In reply to LLevens last post, I am not sure if LCI got any objections, but I know for a fact the Stanleys Casino in Nottingham which opened a few months ago got ZERO objections at their hearing, how this happended, I could only speculate, I don't know the answers (hmmm)

The evidence from the objectors is due back to us on the 28th August, I guess I'll get more of an idea on how the case will go when I can see there evidence, or if in fact I have missed anything. I don't think you need to be a rocket science to forecast their case will contain:

1. "expert market analysis" on demand for poker and/or a casino by some Dr of Gaming
2. Don't give DTD a licence as they will not be able to make any money from poker so they will put in casino tables/or sell to another casino
3. Staneys card room is not full - so how can there be more demand for poker
4. blah blah

I'll be really interested to see LCI's argument that there is no need for DTD when they are having to hold the WSOP Europe in 3 separate casinos due to the demand for poker!

Gala never even had the respect to reply to my offer of signing an agreement not to have casino games/sell ot another casino company, so I guess that is a dead duck.

I wish the case was next week, not in 4 weeks time, we are all fed up of the waiting around and for me personally, whatever the outcome, I am looking forward to putting these last couple of years behind me and focussing on the future for DTD and my other projects, plus having some time to play a few poker tournamants and watch a few more football matches...

I don't know if it's relevant but one part of the demographic that has never really shown a demand for a regulated poker game is that of students...I'm lucky enough to have done OK online over the past year and be able to play the odd £1/2 game at gala, but I know for a fact that a hell of alot of people are put off by these limits which are very high for any student. I have encouraged plenty of people to play but a £0.50/1 game or even lower is as high as the majority are prepared to go, and gala don't even do 50p chips anymore. They seem perfectly happy to throw away £40 on blackjack but then £40 at £1/2 is blackjack...Offering a wider range of limits is hopefully something DTD will do and I think you will then see far more young players then willing to take the plunge...Basically current provision for young players without so much money is utterly non existent, I don't know if that's something you can stress?

DTD's USP (unique selling point) is that it will offer a variety of different games, at a variety of different limits, at a variety of different times. This is far beyond anything that is currently on offer and will therefore attract a new market as well as the already established poker market.

I would love to hear the big boys counter arguement to this claim.

As an ex-student at Nottingham I was still going along to their games last year and there is HUGE demand from students for decent poker. If DTD could work with the Unis poker societies at say a £.25/$.50 game (or maybe £.50/£.50) and ran it once every couple of weeks the students would flock to the club, guaranteed. I chatted with quite a few who would simply never take several hundred quid to a casino game but would happily sit down with fifty quid in a well-run cash game.

With regard to the offer of signing an agreement relating to casino games, the responce of the casinos is not relevant - it's the offer that is important, just by bringing the offer to the attention of the magistrates should be enough to prove your intentions.

Secondly, I would be very careful about usuing the student demand in your arguament. Poker is seen as gambling and students are seen as kids or young people, encouraging young people to gamble will not win you any supporters.

Yeah but the reply to that would surely be "How long have you guys know about this new legislation coming in now? And surely any decent well run company has already looked into what the expected outcomes of that would be?"..Ignorance is no excuse :)

The point is that alot of these students do just gamble with their £50 on blackjack because there is no availability of a suitable poker game which introduces an element of skill. You are correct of course, though, robbing students might look bad :).

God this thing is dragging on isn't it, it must be so frustrating but i am sure sanity will prevail and the license will be granted.
I hope so as i'm planning on moving into the car park so i can be in there all the time. LOL.

Well, I would love to write and tell everyone about loads of interesting new stuff, but not much has changed. Its just a case of turning up Monday and getting the hearing underway.

However, for those of you who would like a bit of background:

1. LIC submitted NO evidence to the Court at all!

2. Stanleys just submitted their company brochure + 1 page of stats on their card room as evidence

3. Gala submitted their brochure AND Stanley's company brochure (!) plus a few pages from the Gambling Act 2005

4. The 3 casinos met up recently to compare notes/discuss their strategy, apparently at the new LCI casino. I am told by a very reliable source that they now aim to discredit me in court to block dt (http://www.dtdpoker.com/aff/BlonditesDownload)d (http://www.dtdpoker.com/aff/BlonditesDownload). To be honest, there have been so many rumours getting back to me it has got very tiresome and boring.

5. I went to watch the Gala barristor in action in Bradford V Thistle Hotels, he was very clever and really put the screws on the Thistle Witnesses, although he hardly ever mentioned "DEMAND" (the only criteria the magistrstes consider in awarding a licence) he did manage to throw up plenty of "smoke screens" On this basis, I am sure that I and any other dt (http://www.dtdpoker.com/aff/BlonditesDownload)d (http://www.dtdpoker.com/aff/BlonditesDownload) witnesses are in for a hard time in court.

6. The Gambling Commission have been absolutley great, they have sent a further 2 page letter directly addressed to the Magistrates on the 17th September which was copied into Gala, LCI and Stanleys. I can't say what was actually in it, but it was "music to my ears"

How can we lose this hearing? Dunno - however, the Casinos have already "won" by delaying us this far, so even if dt (http://www.dtdpoker.com/aff/BlonditesDownload)d (http://www.dtdpoker.com/aff/BlonditesDownload) wins, I think the Casinos will still be pretty happy overall.

On the basis of the evidence they've submitted it seems like this delay was all they were aiming for. I think they'll be over the moon if they create enough of a smoke screen to get the magistrate to call for another delay but, like you said, I think they'll be happy enough as it is.

From the evidence, or lack of, submitted it seems as though they got what they wanted i.e. u spending a bloody fortune with no operational income while they have had a few more months of customers that will come dtd's way.
All the best Rob, although i'm sure you'll get a grilling, just jump through the hoops and everyone will be in Notts next month celebrating when the club opens!!!

First and foremostly all the best for Monday Rob.
Secondly surely it is up to the objectors to provide reasons for their objection to DTD's license which appears to be nonexistant from what you have said earlier today. It looks to me that they could be found guilty of wasting the court's time if the best they can come up between the 3 of them is company brochures etc. But I'm sure as far as they are concerned they have achieved a great deal by keeping DTD from opening back in March, many a man would have given up the fight but credit where credit is due Rob hasn't keeled over and has vowed to fight this all the way.
The very best of British to Rob and all of the DTD team on Monday and like everyone has said before me fingers and everything else crossed for you.

Haha, "don't count chickens" comes to mind, but seriously, there is absolutley zero reason why we should not get this licence, I know it, and so do the 3 objectors, and I am sure the court are well aware of the delaying games that have been employed here. I am 100% confident, there is no need for luck, if for some crazy reason I do not get a positive result, I have plenty to do outside of poker to keep me busy.

Just to add my good wishes. It's hard to see how this case can possibly last 4 days.

Surely any attempt to discredit you has to be irrelevant to this hearing doesn't it? Isn't this hearing all about demand for the facility? I would have thought "fit and proper to run this sort of establishment" issues were covered under the casino licence process?

The Barrister will try to throw up smoke screens and ask questions in a verbally challenging way .. i.e. big words confusing sentences... All you have to say is "I dont understand the question could you re phrase it please" Two things 1) it will throw them as they will have there preparred questions but not alternates and two you can guarantee the magistrates won't understand and they will be thankful that its been made more comprehensible.. Short answers as well...

Surely that means they will have to do twice as much preparation though... Having said that I really don't think warning them to prepare questions in plain English will have much of an effect on the outcome of the case!

Thanks for all your kind words and advice.

Many Gala, Stanleys and LCI employees have also told me that I have no chance - "cause their boss told them this and that blah blah blah", but as I have always said, I remain supremely confident even if other people do not share my view. IMO all I am up against is a few hired hands in suits, the Magistrates (who are just normal people like me and you) will see straight through them and their underhand tactics and then this will all be ancient history, dusk till (http://www.dtdpoker.com/aff/BlonditesDownload) dawn (http://www.dtdpoker.com/aff/BlonditesDownload) will open, and people will be saying "do you remember those donkey casinos who tried to stop us opening, what a bunch of jockeys they really were".

I mean, how sick is it that when the recently opened Stanleys Casino applied for their casino licence in Nottingham - they received NO OBJECTIONS, and I have all 3 against me..........how can I or anyone else have any respect for the way these casinos do their business?

This case is a land mark - and one that the magistrates should be proud to be involved with. Granting this will give so much to Nottingham and the surrounding areas - how can they possibly say no?

There are so many people holding their breath on this one - last night at Luton it was the talk of one of the tables I was on - people wanting to escape the gaming tables and just be able to play poker.

Well, its finally arrived, "D" day, the dusk till (http://www.dtdpoker.com/aff/BlonditesDownload) dawn (http://www.dtdpoker.com/aff/BlonditesDownload) case begins at 10am tomorrow and the Magistrates Court has allowed 4 full days to reach a result.

I predict that the result is annouced either way by end of play Tuesday, Wednesday at the very latest. This is based on the fact that I have decided to use only 3 witnesses (Myself, Simon (http://www.blondepoker.com/blondepedia/blondepedia_view_player.php?player_id=400) Trumper (http://www.blondepoker.com/blondepedia/blondepedia_view_player.php?player_id=400) and Mike Wiseman) and the fact that the 3 objectors collectively submitted next to zero documentory evidence.

There was always a faint hope that one or all of the objectors would pull out at the last minute, but I never personally expected that, this case has become more that just a "routine casino application V objectors" - somehow it has developed into a bigger fight than that....for both sides

Its been a long journey, I'd like to say full of "highs and lows", but there have not been that many "highs" except maybe looking at the building now that it is finished, and the fact that a few lads who went to school together achieved that.

Looking back, I would never have got involved in dt (http://www.dtdpoker.com/aff/BlonditesDownload)d (http://www.dtdpoker.com/aff/BlonditesDownload), taking into account the licencing problems and everything else that comes with this industy. I never launched dt (http://www.dtdpoker.com/aff/BlonditesDownload)d (http://www.dtdpoker.com/aff/BlonditesDownload) to make £millions, it was just an idea that sort of ran away with itself, and I stubornly refused to be pushed around by the casinos, so we are where we are. It is always right to stand up for yourself, no matter what the financial costs, as this will make it easier for other people to stand up to these big companies in the future, plus, its hard to really respect yourself if you crawl away into a corner when faced with adversity.

Outside of poker, I run professional successful businesses but my important decisions are always based on gut feel and not based on financial rewards, I liken a "business" to a "community", there are good and bad in both, but if you are "good", you will have respect, which makes you feared, unpredicatble and dangerous to your adverseries. I believe in the poker business/community, I am respected, and the casinos are a necessary evil at the moment, and I also I believe that this will be demonstrated in court, and dt (http://www.dtdpoker.com/aff/BlonditesDownload)d (http://www.dtdpoker.com/aff/BlonditesDownload) will win resoundingly.

If we do get the green light this week, I will take a break to re-juvinate, as I am very tired to be honest. The background work that I have been doing to get us to this position has taken its toll on me, most people don't see what has been needed to be done. I will need time to get my "enthusiasm" back, as there are many things that have really disapointed me to do with this project, not only licencing related.

Despite being pretty fed up with the whole dt (http://www.dtdpoker.com/aff/BlonditesDownload)d (http://www.dtdpoker.com/aff/BlonditesDownload) Project, the last thing that I will do is roll over and let the casinos win this week, in fact, in a perverse way, I am looking forward to finally locking horns with them as I am so sure that the magistrates will see what is really before them, and not be persuaded or influenced by their trickery in court. I also look forward to silencing a few of the so called "experts" who have been predicting my downfall behind my back, after all, I am only human, and crushing your enemies and critics has to feel nice (no matter how humble you like to see yourself).

I'm off to my pub tonight to do the Sunday £1 Quiz, then hopefully get a decent nights sleep. Nick is picking me at my house at 8.45am, then we'll fetch "Aces" Trumper, park up in town, grab a coffee, meet Mike Wiseman and my lawyer, Andrew Woods, at the court..........of course, I will find a way to keep you all updated on this thread, and I know many of you are genuinely behind me, even though we have never met face to face.

I would love to give you all a detailed update of the proceedings today, but it is not permitted, we were told under no uncertain terms that the contents of todays hearing were not to be made public. I'm not sure exactly why, as there were members of the press present, but I have to respect the magistrates courts directive, especially as extracts from my Blondepoker dusk till (http://www.dtdpoker.com/aff/BlonditesDownload) dawn (http://www.dtdpoker.com/aff/BlonditesDownload) Diary were used to cross examine today me by the Gala barrister.

However, what I can say is :

1. All parties agreed that this case will not last 4 days, and a decisions end of play Tuesday/early Wednesday is likely

2. Nothing happended today that has changed my view of a positive outcome for dusk till (http://www.dtdpoker.com/aff/BlonditesDownload) dawn (http://www.dtdpoker.com/aff/BlonditesDownload)

3. There were only 2 objectors, London Clubs International decided to withdraw their objection 30 minutes before the case began.

Wern't LCI the ones who were willing to drop the objection when Rob was prepared to sign a document stating that no other table games would be played other than poker. I think LCI know that Rob is a man of his word and can't be arsed with the hassle and cost of a court appearence..........

I had to leave the hearing at 12pm today, to attend a funeral at Redditch of one of my longest serving staff, Lisa Bayliss. She took her own life tragically last week at the age of 35 - I decided that no matter what was happening at the hearing, I would make it to the funeral, when events like this happen, it really puts a casino licence into perpective.

Anyway, the latest news from today (Day 2) is:

1. The 3 Magistrates visited dusk till (http://www.dtdpoker.com/aff/BlonditesDownload) dawn (http://www.dtdpoker.com/aff/BlonditesDownload) today and were given a tour by Simon (http://www.blondepoker.com/blondepedia/blondepedia_view_player.php?player_id=400) Trumper (http://www.blondepoker.com/blondepedia/blondepedia_view_player.php?player_id=400). They also visited London Clubs International's card room, apparently they were already familiar with Stanleys and Gala casinos.

2. All evidence from dt (http://www.dtdpoker.com/aff/BlonditesDownload)d (http://www.dtdpoker.com/aff/BlonditesDownload), Gala and Stanley has been given now. Gala and Stanleys put one Director from each of their companies on the stand today.

3. Tomorrow at 10am, each of the three Barristors will give the "closing statements" to the court, then the court will break for lunch, and between 1pm and 2pm we will get a decision.

sorry to hear about the tragic loss of life of lisa rob. i didnt know her but am saddened by such a loss of life at such a young age.
my thoughts are with her family.

It takes a second to say yes and also a second to say no ... Bear in mind that they will have to have there reasons for any decision and big business are involved ... That's what they will be running through now ... Also the highly specialised nature of this case will probably mean lots of guidance from the Clerk ... As i mentioned earlier .. Lets hope the Clerk is familiar with Poker !!

I had to leave the hearing at 12pm today, to attend a funeral at Redditch of one of my longest serving staff, Lisa Bayliss. She took her own life tragically last week at the age of 35 - I decided that no matter what was happening at the hearing, I would make it to the funeral, when events like this happen, it really puts a casino licence into perpective.

Anyway, the latest news from today (Day 2) is:

1. The 3 Magistrates visited dusk till (http://www.dtdpoker.com/aff/BlonditesDownload) dawn (http://www.dtdpoker.com/aff/BlonditesDownload) today and were given a tour by Simon (http://www.blondepoker.com/blondepedia/blondepedia_view_player.php?player_id=400) Trumper (http://www.blondepoker.com/blondepedia/blondepedia_view_player.php?player_id=400). They also visited London Clubs International's card room, apparently they were already familiar with Stanleys and Gala casinos.

2. All evidence from dt (http://www.dtdpoker.com/aff/BlonditesDownload)d (http://www.dtdpoker.com/aff/BlonditesDownload), Gala and Stanley has been given now. Gala and Stanleys put one Director from each of their companies on the stand today.

3. Tomorrow at 10am, each of the three Barristors will give the "closing statements" to the court, then the court will break for lunch, and between 1pm and 2pm we will get a decision.

My next post (and maybe the final one) on this thread will be THE RESULT, good or bad.......the dt (http://www.dtdpoker.com/aff/BlonditesDownload)d (http://www.dtdpoker.com/aff/BlonditesDownload) project - "the set up of Europes largest poker club" will be at last over...............

Yes, its correct, we have won (no chance of any change/appeal etc) and we are in my pub having a beer now.

Don't think they can get costs. Application for the licence is due process and anyone can object. Thank God this came through and the Magistrates seen the light, and thanks to the clerk of the court who would of directed them in that direction.

EUROPE'S biggest poker club will be allowed to open in Nottingham, magistrates decided today.

Dusk Till Dawn will open on the Lenton Lane Industrial Estate in early November.

Rob Yong, an entrepreneur from Nuthall, was today granted a Casino Licence for the club. He has spent £3m redeveloping the former Smilin' Sams amusement arcade as a card-only club, the first of its kind in the UK.

I had a few to celebrate last night down my local pub too, my local pub is my local poker club so to speak, and were all looking forward to coming up to Nottingham as soon as it opens......Ayyyyyaaaaarrrrr!!!

Congratulations Rob and all those involved!

This is great news. Read the article on pokernews and I gotta say I don't think I would have been as kind to the casinos by not offering slot machines etc. at the club when you had the choice. I would have, if only to stick the knife into the greedy b*******. Very classy. Your obviously a better man than me.

Already planning my trip down sometime near Christmas.

Yes a very classy and astute man.  Took on the big boys and took them down a peg or two. 

A great milestone for poker in the Uk and Ireland, there is pleant of flights to East midlands from Belfast.    Just wish i lived closer lol

It was far worse when I viewed it.

I appreciate your comments MPOWER, and understand what you are saying.

I was pleased though to see the journalist who reported yesterday's successful conclusion sounded like, although he has to be unbiased, he was actually just as appalled at the casinos objections as we were.

People are worried about "problem gambling" in Nottingham with the recent opening of Stanleys and LCI making 4 casinos in Nottingham, I was asked this on 3 radio shows today, its hard to explain that Poker is different to traditional casino games, so I understand why there will be some negativity to the opening of another "gaming" venue in Nottingham.

It is nice to see the creative types actually read the articles in the paper thay are writing to.

One chap wrote a poem about the "New Casino", see DTD, and the woes it could cause. We first thought it may have been written about one of the 2 new casinos, but no, in the poem it states "made use of a disused building,".

Non league football, brilliant.

I used to work for Colne Dynamos going back a few years, they were the only pro team outside the 4 english divisions at the time, Alan Kennedy ex Liverpool was there playing at the time and the club enjoyed some good success. I worked in the commercial side with Paul Fletcher (ex bolton player) and now working for Coventry City... fond memories indeed. And non league club fans are the salt of the earth, look after them Rob.

Well done to Rob and the team for this successful pursuit of JUSTICE. Rob must have went through the mill both mentally and financially in the last year and he has shown himself to be a man of great pride and modesty. This proud son of Nottingham has given back to his community again at great financial risk to himself and knowing that it will be a long time before he sees profit if at all, as I'm sure he will have already started planning new poker innovations to cut the jugulars of the opposing Casinos poker business. I personally think he has saved many people from financial ruin as people will be able to cut the bankroll leakage of casino games.
