Title: [ x ] justice
Post by: outragous76 on September 29, 2009, 04:28:45 PM
So I was up in court today for the first time in my life (magistrates) on a 'speeding' charge - i use the term loosely! (Tikay dont read on - i seem to remember you dont mind traffic police - old thread somewhere)

Basically some cock in a Porsche was driving like a prick 'near me' and copper pulls us both. Offers me 3 points, I  told him id see him in court. There was no evidence except his word btw, no radar, no 2nd police officer etc.

The above was december, and i wasnt summons till May (3 weeks before staute would have seen me not guilty). I then get a PC's statement which in short was lies. The Scum bag had chosen to concoct his own little version of events which 'made sense' to try and pin it on me! Unfortuantley for the arrogant c@#t, he didnt do a very good job and it had more holes than a cullinder.

None the less - i chose to have (very expensive) representation. To cut a very long story very short, they wanted to submit 'new' evidence to the court this morning incluidng the officers 'new note book' from that morning. The little scum bag was still trying to make things up after we had disclosed our defence to them. They triied for (what was now a 3rd) adjournment, in order that they could serve more papers on me. Fortunatley we won this point and it wasnt adjourned.

The case was thrown out and I have my reputation in tact and a clean licence. You may ask why the anger..................

As far as the law was concerned I won on a 'technicality' (not saying i wouldnt have won by giving evidence - but i was advised that this would be an 'on the day type decission - they gave me a 50/50 on that route - and i dont flip like LeKnave does!)

So basically - if i hadnt chose to pay for good legal advice - there is a very high probablility that 'just because a police man says so', and despite the fact that to any sane person it is lies, i would have been guilty today, facing a fine and my own costs.

Not only that - but because of the lying scum bag - the state will pay my solicitors fees, so if you want reason to be annoyed at this c@#t too - there you go. For the sake of wanting to get a notch on his statistics, he has cost you £2500.

I cant stand the facts of this case. It makes me want to be sick. Dont get me wrong, I am delighted, but why should I suffer 9 months of stress just to be this c0cks statistics for the week?

[  ] wp PC Farley - you are an upstanding officer
[  ] i respect our traffic police
[ x  ] I am a law abiding citizen

If the guy in the Porsche was speeding surely he couldn't have been 'near you' if you weren't speeding - he'd have been pulling away from you?

I cant resist posting my favourtie one of the lies..........

My 'recorded speed' (without recording capacity in the car except his speedo) was 86mph - as noted on my fixed penalty notice on the day

The statement (referring to both cars) - prepared some 3 months later

"I followed the vehicles from a constant distance of 200m over a distance of 0.5 miles  and measured the vehicles' speed by using the calibrated speedometer marked on [his car]. The speedometer on the police vehicle displayed between 90 and 95mph throughout the entire check"

O'rly - constant distance eh!

"Both vehicles remained at a constant speed and constance distance"

O'rly - for half a mile! - despite the fact that once he asked me to pull over he had to accelerate away and catch up to the Porsche !

The rest of it was as believable!

I wouldn't tarnish all traffic police with the same brush though.  I've met some very decent ones, and they're only enforcing the law and doing their job.  I imagine it's like most things - there are good ones and bad ones - unfortunately it's often only the bad ones that are remembered.

I drove a Porsche for the first time last week. I immediately started driving like a cock and felt powerless to resist the urge to do so. I think this is normal and should be allowed.

Kin

Im afraid that my experience is very different. I was once pulled over because my "rear lights werent red enough" at 4am on a Monday morning. Had to do my producer in Brixton police station - their sergent was furious and mutter "and we are trying to stop people killing one another".

I have no problem with them enforcing the law - but in my experience they are all arrogant smug tw@ts. The bloke today couldnt care less for the stress I have been through - and there will be no retribution for him will there? If I win, then why isnt he disciplined for lying? Joke!

Not suprised one little bit about this, I hear lots of similar stories as friends and family are often defending people who have been screwed over by police not clever enough to get their story water tight. Virtually all of these you can get off with if you hire someone who's clued up, but these cost as you well know.

Not a wind up.

We can all bring out a couple of anecdotes to show that the whole police force is corrupt and that traffic cops take delight in getting people done for trivial or trumped up charges.  If I mention a few positive anecdotes does that make all the police OK?   Like I said, there are definitely bad apples in the police, and I'd love to hear all the details in this case.  I'm sure the police office in this case was a complete *****.

I brought in a local community police officer into college a few years ago to speak to my students and educate them on the his job etc.. He had been a police man for 20 years+ and the last 3 as a community one, speaking in schools, colleges. We had a little question and answer session at the end of his talk and one of the students asked about the people joining the force today and and their motives for doing so.

I was absolutely astonished with his answer, it was basically most new recruits were totally inappropriate and joining for money or a power trip. He said it was really sad for him to admit this but he was often ashamed and what the force had become. All the students were like wow.

Given this plus what my wife tells me (she works in law) regarding corrupt police and clogging up the system with false charges due to them being on power trips makes me think its a 50/50 coinflip on good cops bad cops.

I had some great experiences dealing with police when I was involved in a car crash, but so so many negatives watching football games.

and at the same time I know of at least 4 people who, over the years, have failed to make the grade to join the police for one reason or another, all of whom, imo, would have been great in the job, and doing it for all the right reasons.

LOTS!

This kind of thing is always in the back of your mind. I have also had an extremely stressful 5 months of life generally (redundancy etc), and the last thing you need is 3 court dates where you turn up and it gets cancelled, or they cancel the week before.

So yes - im not going to say i worried everyday, but worrying about something i just shoudnt have to is unacceptable.

They can also be punituve with points if you plead not guilty and lose. Although I have a clean licence, i need my car for work - and 6 or 9 points would totally screw me over!

It is a sad fact that many people who have been in the same job / with the same company for a long period get a bit disillusioned, and often have a 'things aint what they used to be' attitude.
This skews their view on events / people within their workplace.

I'm with Kin on this.
I've met some very good Police people, and occasionally one that isn't so good.

Just because you meet a bad one, doesn't make all Police bad - but it amazes me how many people think that way.
IMO it's an attitude that has a parallel with racism.

Traffic cops are ignorant of the law and fail to do there jobs properly quite often. I work with an ex traffic cop and he can reel off rule this rta section blah blah but when i asked him about terminal signs and a case that has been used several times in court as a defence he had no clue and pretty much said they'll get you on something else then !!!! Also tried to tell me it's a 12 month time limit for serving a citation. LOL.

I really am going to enjoy the look on their faces when i get the speed limit ruled unenforceable in court as they are cracking down to the extent that average cameras. Pricks.

you pass a camera in a 30 zone at 29 mph you then do 50 mph untill you see next camera and slow down pass as 29mph
before you got away scot free but with average speed cameras they catch the crooks

What?

Installed soon?

Theyve been around for ages. The yellow cameras high on blue poles. Often found on the M1, and all over Nottingham.

You sure will be getting the speed limit ruled unenforceable!!?

The secret with them is to remember that they are one camera per lane.  ;)

As for the terminal signs and how to beat a speeding rap well i have to say you won't actually beat a speeding rap but you can alter the speed limit if the signs are incorrect.

http://www.abd.org.uk/speed_limit_signs.htm

There are a few examples of wrong signs if you know what to look for.

Yeah I read into this a while back and if you switch lanes on the average speed check you won't be caught pretty much.

surely on, for example, a 3 lane road they only need 4 sets of cameras to ensure that at some point you pass through 2 on the same lane so they'll get you

Yeah I read into this a while back and if you switch lanes on the average speed check you won't be caught pretty much.

You can visably see where the cameras point. You cant just swap lanes because the cameras are all linked.

Going between DTD here and the city hospital there are about 8 of these cameras.
But only one at each point. These are on the fast lane.
As long as you go through no more than one of these cameras you can go as fast as you like.

You get some beautiful looks when you go through the 40 mph zone cameras at 90mph, but if like me you come from dtd and turn left at the island there are only two cameras, so as long as i miss either camera, they dont pick up my average speed.

Same on the M1 but less useful as they have 3 when there are four lanes, so you know you can do 100 in the slow lane, but you obviously cant cus there all doing 12mph.
