I'm pretty sure that the law differs as to whether it is a wage overpayment or whether it is just a random deposit that has appeared accidentally, with wages I believe they are more lenient and allow you quite a lot of leeway on you repaying it. With an accidental credit to your account it's classed as theft if you spend it.

I work for a bank, if the money is put into the account in error they will always chase the funds back and they have the right to.

I helped in moving the I.T. infrastructure of a large Bank into their new at Canary Wharf, whilst the move was being implemented their was a discrepancy in the number of people being moved. It turned out that a member of staff we were supposed to be moving had left almost 5 years previously. The bank had been paying them £80K a year.
The member of staff had saved all the money in a high interest account with the same Bank.
He had to pay it back but the talk at the time was saying that if it had gone over 5 years they wouldn't have chased it.

Is it an assumption that it is the bank at fault, rather than the sender of the money? Either way, as above put the money somewhere to earn a bit of interest until he/she is contacted.
