get your brother to name you as the contact for leasing the property that way you are allowed access at any point to inspect the house, you also then can hand him a letter telling him of noise complaints and that it goes against his lease conditions, then you can tell him that the lease does not allow him to work from the property.

I had similar with next door neighbour a few years back with late night parties, they used to start around 1 am and go till about 4. not great when i get up for work at 5:30. started off at weekends and ended up being 4 times a week.
Threats did fuck all, the police were even more useless.
the only thing that worked was phoning the council/environmental health every time, and logging the noise, then speaking the environmental health officer.
They went round and threatened to take his stuff away, and it stopped straight away.

re: the grassing up - I can understand about the not grassing for benefits, but fucking about in cars down streets with kiddies playing in is another matter, think the police should be made aware of that

This.

If you do nothing and a child is seriously hurt or killed, how would you feel knowing that you could have done something to help prevent it?

dont blow him up to the police or social, he is 100% in the wrong, he could twist it round that your the baddy ,you cant explain whats  happened to everyone so you could finnish up with a lot of neighbours thinking you are trouble and cant be trusted,if you are going to hit back with noise i wouldnt do it at night,do nothing for a week or so and log his routine, what days to hit back to hurt the most, explain to neighbours otherside of you whats going on .do it early in the morning,dosent have to be music blasting, DIY with a big hammer for hours ,it will take the shine off his little parties,if you know he is scared stiff of you, he cant have much backing running to the police so if he trys to run off when you have been making the noise stand at the front door with a big smirk when he comes out of the house, humiliation will be hard to take.

        i went to play the 20 20 at DTD yesterday ,got knocked out early after getting kk cracked 4 times in the first level .
after buying in to the 50 freeze out at 8 ,i get a call of the wife telling me they have been partying again and have thrown a 4 foot mirror over my front garden ,it had smashed on the fountain ,i was home by 8.45 .

          when i got home the front garden has glass every were ,this hasnt stopped since last year ,but hasnt been as bad .the thing is every time i have been round he rings the police .so last night i did it for him .
  the only thing is when theey turned up it was me who got locked up .the piece of s..t was stood on his doorstep shouting what he was going to do .god this scruffy idiot is a mug .my brother has just rang me and told me they have had the kids took of them ,they are blaming me .how the feck is it my fault ,i dont party untill the late hours ,i dont stand there swearing at them (as he does )you can here him bullying the oldest one who is 3 years old and not his .
 
           all hell broke loose around here last night untill about 1.30 this morning it was mentle  ,the police let me out at 4 this morning with no charge ,they have given me a number to contact monday morning so i can get them out .

IMO you should go play poker somewhere like 40-50 miles away one night wait until the comp has started then send your boys around, this was you have proff it was not you and you had nothing to do with it

An agent or landlord has no legal right to access the property, unless for safety concerns ie gas leak or property not secure, and the tenant is entitled to change the locks to unsure that no enter is made without their consent. Even if the tenant is in breach of the lease/contract you will have to go to court and issue a section 8 under certain subsections but these are often subject to the whim of a judge. If they are more than two months in arrears you could go for a section 8 under these grounds and this is normally the quickest method to evict someone, but even this takes months.

You stated that their tenancy ends in a 4 months. The best but is to sit out this period and not renew the tenancy. But if you do this make sure your brother takes out a section 21 order asap setting the end date of this tenancy term otherwise the contract will automatically transfer to a periodic tenancy which means any notice given at this stage will mean the tenant has a further two months before they have to move out. It's a pain but unfortunately you have to make sure you use the correct legal procedure or you could find your stuck with them longer than you have to.

Having said that you have tried to be reasonable with him but he isn't interested. Even worse it is he who is hiding behind the law like a little scumbag. Sometimes you have to deal with some people in the only way that they will understand. As a result "old school" rules apply to this guy if only to teach him some respect.

I understand your frustration but to get it resolved you need to be systemic in dealing with the issue rather than being emotional. The tenant has only cost you money if they damage is left unresolved once they have moved unless you are in the process of selling your house now and accepted a lower than market value offer. The fact the landlord is your brother puts you in a far better position than most people in a similar situation. I have outlined the legal procedure for you. The only other alternative you have, if you wish to get ride of them asap, is to see if they will sign a "deed of surrender" which means they leave the property on a set date prior to the one agreed in the tenancy agreement. This deed needs to be signed by both the landlord and the tenants and in effect realises both parties from their legal obligations. The question is, is the tenant likely to take this option ?. Not by the sounds of it. He seems like the neighbour from hell but is he really worth doing time for and risk separating you from your family.

Tip. The tenant has a legal obligation to provide a forwarding address at the end of the tenancy. Always handy for those dark nights and means it's away from your own doorstep.

Hi Barry, Diceman has given you the correct information about getting these tenants out. If they've had their kids taken away from them then presumeably the handouts will stop, and therefore the rent won't get paid so things may speed up a bit.

Grassing anyone up is your own choice and no one else can advise on how you woudl feel if you did that. Can't understand how if they threw a mirror over your wall and smashed your garden feature (never had you down as that type of guy tbh Smiley ) you got locked up.. actually I can, you probably lost the plot I guess?!

apparantly he has disorder where he loses his wragg all the time ,so i have a millon do gooders on my back to keep away .
if i had done any thing i could understand it ,i just want them out of my life for good before it gets out of hand .

if it goes on any longer i dont know if i can bite my bottom lip any more.
let one off these so called dogooders have them as neighbours.
