I don't think either is required for a successful prosecution. I believe Gascoigne was charged under s5 of the Public Order Act 1986. http://www.bailii.org/ew/cases/EWHC/Admin/2013/3267.html is an interesting read on what constitutes threatening, abusive and disorderly according to that Act.

Plus it's a load of bollocks.

Don't know why the black dude is humiliated? Surely it's Gazza who's humiliated in this instance? The judge doesn't mention the reaction of the crowd but I can't imagine them rolling in the aisles from laughter here. Probably very awkward, very uncomfortable moment. So don't really know why the black guy is humiliated by drunken mess gazza making everybody cringe or why the judge needs to protect said humiliated black guy from his faux humiliation. I mean really when did everybody start getting all outraged and humiliated by everything? I think we need to start giving society a bit more credit these days, but I do remember Jim Davidson from the 70's, there was also Bernard Manning back then as well. As far as starfish go I would probably tell them to grow a backbone in this example.

Spot on as always mate. Too many professional offence takers around these days that start bleating as soon as you even fart in their direction from 3 miles away.

Gascoigne made a bad racist joke and ended up here.  I am sure everybody has heard far worse and Jim Davidson made a whole career out of it.  It seems odd that they decide to put the boot into somebody so obviously fragile as Gascoigne.  I dare say Mantis wouldn't even have bothered throwing him back in the sea.

For example, Farage's immigrant poster in the EU campaign was far more offensive in my eyes, and far more likely to gave caused an upswing in racial hatred, but we don't see him in court.

Strange times.

This was targeted abuse aimed at an individual.

How is putting the boot in to somebody obviously fragile different to putting the boot in to somebody obviously black?

I don't give a shit how good he was at football, the guy's a twat. He's fragile through his own pathetic doing and deserves to have the book thrown at him.

Thats the thing about these so called minorities. a lot of them are professional minorities employed - probably - by the communist BBC or maoist guardian. they are paid to be black and read Things Written By Clarkson so they can be offended.

they aren't even minorities anymore. have you been to luton recently? you have to wade through thousands of these professional minorities before meeting a native unemployed ukip voter, thousands.

they cant even be offended in the privacy of their own mosques. they have to tell everyone every time they are spat at [bantz] or called raghead [lolz]

whatever happened to the stoic glory days of the blitz? when our enemies where honourable white folk and we showed how resilient we were by looting bombed out houses and robbing jewellry off our dead neighbours fingers. the real east end, gathering around the old aunt johanna  [ryhming slang] to sing bawdy songs. not selling curry and listening to reggae.

Three reasons for a case to go to court and an offender to be sentenced.

Punishment: Don't think it's relevant in this case. The humiliation of the whole case is punishment enough for Gazza I think.

Rehabilitation: I suppose slightly relevant. Although it could be argued Gazza is a lost cause. Doubt he'll ever make a racist joke in public again though.

Deterrent: Absolutely relevant. If this court case stops people acting in this very offensive manner in the future, it was worth the effort and expense of prosecuting Paul Gascoigne IMO.

Points taken.  But do you think Gazza had genuine malice towards this bloke as opposed to being a bit thick?  Can the court distinguish?  Should the CPS be prosecuting people for just being ignorant?

I doubt very much Gazza had any malice towards the fella he made the joke about. And I also doubt this case would have been brought if it was a bloke in pub making the same joke to a group of friends.

But that's not really the point.

It's just that Gazza is very famous and because of that the case gets maximum publicity and maybe therefore it will cause some people to think twice about making similar comments.

Is that fair to Gazza? Maybe not. But he was found guilty, so he did commit the crime for which he was accused.

The price of fame I suppose.

I really must remember that the only right opinion in any discussion is yours Mr Hawkins. I do apologise.

There seems to be no cause you won't align yourself to. You are a true Champion of minority issues, which on a certain level is very commendable. However, you feel it gives you a platform and justification to take every opportunity you then can to criticize folk on Blonde.
