I don't think either is required for a successful prosecution. I believe Gascoigne was charged under s5 of the Public Order Act 1986.

is an interesting read on what constitutes threatening, abusive and disorderly according to that Act.
Plus it's a load of bollocks.

Gascoigne made a bad racist joke and ended up here. I am sure everybody has heard far worse and Jim Davidson made a whole career out of it. It seems odd that they decide to put the boot into somebody so obviously fragile as Gascoigne. I dare say Mantis wouldn't even have bothered throwing him back in the sea.

This was targeted abuse aimed at an individual.

Thats the thing about these so called minorities. a lot of them are professional minorities employed - probably - by the communist BBC or maoist guardian. they are paid to be black and read Things Written By Clarkson so they can be offended.
they aren't even minorities anymore. have you been to luton recently? you have to wade through thousands of these professional minorities before meeting a native unemployed ukip voter, thousands.

Points taken. But do you think Gazza had genuine malice towards this bloke as opposed to being a bit thick? Can the court distinguish? Should the CPS be prosecuting people for just being ignorant?

I doubt very much Gazza had any malice towards the fella he made the joke about. And I also doubt this case would have been brought if it was a bloke in pub making the same joke to a group of friends.
But that's not really the point.
It's just that Gazza is very famous and because of that the case gets maximum publicity and maybe therefore it will cause some people to think twice about making similar comments.
Is that fair to Gazza? Maybe not. But he was found guilty, so he did commit the crime for which he was accused.
The price of fame I suppose.

There seems to be no cause you won't align yourself to. You are a true Champion of minority issues, which on a certain level is very commendable. However, you feel it gives you a platform and justification to take every opportunity you then can to criticize folk on Blonde.
