well i'd be careful cos, putting myself in his shoes, I'd contact the police and say that there was this guy threatening me for money claiming that i'd played on his poker account when in fact i was in a drunken stuper, he must have got wasted himself and lost shedloads of cash and is now looking for someone to blame!

this is a nightmare and a lesson to us all (though if anyone ever got into my accounts theyd probably feel sorry for me and transfer sum cash in lol)

OK, checked this out for you. You can indeed prosecute if you can prove it wasn't you who was logged in. This type of crime comes under the Computer Missuse Act.
google that and have a read, if you do want to take it further and have anymore questions PM me.

Not been able to get in touch with him from 2:00pm onwards. However he has admitted it was him to two of my freinds when they rung him up this morning. He has also told them that he has spoken with his mum and she has agreed to write him out a check for £3100 and he will pay back £250 per month. I dont believe a word of this and if i don't hear something of it tommorow by the villian. I will seek legal action. Obviously when i seek legal action, i will have written the money off. However i need to see this guy punished for what he has done. Guess ill just have to redeposit on stars again and build up from there.
The bright side of this matter is the overwhelming support that i have recieved via p.m and on this thread. Its nice to know that there is a community that will endevour to help members with both trivial and serious matters. I hope i can be of the same help to someone in this future. Cheers guys

Good news hopefully.
Villian just rung me up. Said he has spoken to his mum and she is pissed off but is going to write a check out. She has to move some funds about to make sure that the money comes out of the right account. "100% you will get it in a few days" he is genuinely remorsful. Although what he did was terrible in his drunk and deluded mind he was trying to win me some money, and some for him self probably. I would be more pissed off if i caught him stealing £50 out of my wallet, that having said obv i can never trust him again.

I dont beleive that Action Man can be blaming himself for leaving his account accessible in any way at all.
Its like leaving your front door open and getting burgled, an insurance company may not pay out but it doesnt mean that a crime hasnt been committed.
This toe rag has robbed you, just the same as had he dipped your pocket, he is now in the process of robbing his mum to avoid the consequences of his actions, probably not the first time nor by the sound of it the last.
Dont forget it is not for you to prove anything, you make the accusation and the police investigate, thats the system, the fact that you made it easy for him to gain access is not relevant, only wether he had permission or not.
Hope you get paid out, but his mum is the one I really feel for.

But unfortunately in todays modern society you can't leave your front door open, its up to you to make sure that all your valuables are in safe keeping which means keeping them well locked away. I recently had a similar problem when i had my laptop stolen, normally i had the box ticked to remember password as no-one else has access to use it. Thankfully when i got laptop back my poker accounts remained untouched but i've now unticked all the remember password boxes so that if it happens again my accounts will be safe.

while i sympathise with your loss it pains me to say that with any personal data the onus is on the person in question to protect such data from third parties that may wish to defraud them in any way.
this may be done by setting master passwords, changing passwords, NOT saving passwords on sensitive programmes - DTD, stars etc. if you cannot remember and retype this information to log into your account then there is little that can be done. from a legal perspective it would be all to easy for the scumbag to merely say that you yourself lost the money and blamed it on him, this would hold up better if the data was accessed from your own personal computer, as again the onus is on yourself to protect your private data.
for the future i'd reccommend unchecking the "save password" box on all of your poker and banking related programmes and websites, as an aside, old statements from the bank, and documentation that can also be used to fraudulently use your name should be shredded or incinerated, not thrown in the trash.
privacy is a bugger to keep these days
