Was reviewing an agreement with a partner company today, and came across this clause.

The words and phrases “including” and “in particular” shall be without limitation to the generality of any preceding words and any preceding words shall not be construed as being limited to a particular class where a wider interpretation of those words and phrases is possible.

What a load of nonsense.

I can't believe that all this time I've been construing preceding words as being limited to a particular class where a wider interpretation of those words and phrases is possible.

The really interesting bit is that the words "including" and "in particular" do not appear anywhere in the agreement, except in this clause.
