scene - Live cash game blinds £1 - £2  5 people on the table stacks are between £50 and £200

We have £180 in front of us.

Action, we are UTG, we have , we make it £7 to play, UTG plus one calls, everyone else folds.

UTG +1 player is drunk off his arse, has no clue how to play and has about £90 in front of him he managed t fish off me a few hands before with a 3 outer on the river when money was in on the turn.  He has been warned about putting his vards over the line and about exposing his hand for all to see.

flop comes  Two Diamonds    Two Clubs

We bet £11 at the pot,

UTG+1 fella reraises to £25, I flat call as he has been raising with feck all for the past 3 rounds and has no clue how to play anyways.

turn card is 

I bet out £54 with my flush draw and overs, UTG+1 fella shoves all in for £6 more, he then esposes his cardss to the table showing 6 4 off and throws them on to the muck pile....



now dilema, 

What do we do with all of this information, we have cards to hit and take the pot, or should we just stick rigidly to the rules at take the pot now since he has been warned and let off with mucking his cards 5 - 6 times already?

I would love opinions on this.

3bet shove the flop with one hand in the air.

I would leave it to the dealer to make the ruling and argue my case that his cards have hit the muck therefore dead.

LOL was going to put exact same thing although i prob would've said one finger in the air i prefer that, feel it has better effect
