OK well, I was playing last night a 200 EURO tournament in the only casino on the island...  Only one every 3 months

Level Things up 5,000 starting stack, third level at 150/300 and I had doubled up and added some on to 13k and then the CL who had knocked out 7 people in 3 hours, got moved to my direct left and this happens (also spanish only at tables, which makes it harder for me)

Whole Cards...  ... UTG, I raise to 900... CL re raises to 3000 (smooth call after everyone gets out the way)

Flop

I check, he pushes in 9000 and I move all in for 1k more. He is very lose and I put him on a strong ace

But then the TD walks in and notices the dealer has not burnt a card...

which makes my set worthless and now only a pair and he is made to burn it and turns over  two hearts (now at this point, I kick off not knowing what is going)

Now I ask for my chips back due to the dealer mistake and declare the hand dead... but no, my chips are in and im all in, of course, he has an Ace and i hit the rail...

BUt my question to you guys is

1. Should i get my chips back as the game has changed and has changed the betting structure
2. Am i wrong to flip my cards over on the flop, after i was told im not getting my chips back
3. Am i wrong saying I should be getting my chips back from my all in move, but not my pre flop raise? help im going mad!

Flop was incorrect and the mistake wasn't corrected until after betting took place so both players have gained knowledge on the strength of each others hands based on an incorrect flop.

IMO this should be treated the same as a mis-deal and the hand declared dead (I'm no rules official though so is just my opinion).

what is the standard ruling here then?

ruling from Roberts is

Quote
“…..If the dealer fails to burn a card or burns more than one card, the error should be corrected if discovered before betting action has started for that round. Once action has been taken on a boardcard by any player, the card must stand. Whether the error is able to be corrected or not, subsequent cards dealt should be those that would have come if no error had occurred…..”

TDA much the same I believe but so basically the first (incorrect) flop has to stand

hand should never be declared dead

what is the standard ruling here then?

common sense would dictate that post flop bets should be returned, the cards shuffled and the flop redealt, surely?  at the very least the flop bets should be returned and the flop correctly dealt with the 7 as the burn card.  In my humble and very unknowledgable opinion of course.

I prefer this (unless I'm the guy with the ace)
