He's arguably broken it himself


a person must not cause or permit any other person to use a motor vehicle on a road [F2 or other public place] unless there is in force in relation to the use of the vehicle by that other person such a policy of insurance or such a security in respect of third party risks as complies with the requirements of this Part of this Act.

A quick call to the insurers is always your best bet here.  If you're not insured, they might be able to stick you on for a few days for not a lot of money.

As played, ignorance is no defence in the eyes of the law.  But I'd be getting my brother to pay the fine.

This habit of "sticking" someone on has hidden dangers. It's not often realised that, as far as Road Traffic Law applies, the insurance is deemed of no effect until the certificate has been delivered.

"A policy of insurance shall be of no effect for the purposes of this Part of this Act unless and until there is delivered by the insurer to the person by whom the policy is effected a certificate (in this Part of this Act referred to as a “certificate of insurance”) in the prescribed form and containing such particulars of any conditions subject to which the policy is issued and of any other matters as may be prescribed."

Whether you going to be disqualified, and for how long, for speeding depends on, amongst other factors, driving record, other offences, e.g. no Insurance, and speed.

You can get the certificate emailed through immediately.

So the car is in Leeds with you (family car) and the family isn't in Leeds? So who normally uses the car in Leeds? If it's you at Uni then you have been using it illegally for longer than you thought.

in answer to op, if i were ur brother id offer to pay the fine (not the speeding one though). it ultimately comes down to you though. sorry

i know it does come down to me but. could he not just spend 5 mins of his life to read a document instead of playing WOW 24/7

i would of never drove. makes no sense to travel all the way to lincoln just to read a document

6 month ban is a bit harsh.is this standard?

believe it or not i was quite relieved that i only got a 6 month ban

the police said i was traveling very fast with speeds up to 110-130mph

thats in a 1.6 for focus lx

Very simple answer to this one;

Ignorance is no excuse.

1; You were speeding (which I do too so not preaching here) and you got caught (which is just plain stupid)..and doing 110-130MPH?...you probably will lose your license permanently next time.

2; you didn't have insurance and should have known this.

6 month ban is standard IMO.

With regards to your brother...yeah you could blame him for not reading it properly...on the other hand; He's your brother and you probably know him fairly well....so you could have known he was unlikely to read it properly.

Be pissed at your brother for being a lazy twat...and pissed at yourself cus you should have known better.

no one drove to leeds

i lived in leeds whilst at uni

no one else could of drove and my mum didnt want to waste 170 quid to pick my grandma up when u can drive there for 60.

so when you went to lincon to pick up the car why didnt you check the docs before you got into the car and drove

loads of people have told me they are insured to drive any car

but i certainly wont let them drive my car without seeing full proof they are fully comped in my car

I'm with Robert on this one.  From every piece of anecdotal evidence I've come across anyone caught doing over 100mph has ended up in court (with one or two exceptions for some very lucky people who were doing just over 100).  All the ones that have gone to court have seen at least 6 points and a hefty fine, and if you're doing towards 130mph it would be an instant ban I would have thought.

Robert, would it be classified as dangerous driving?

Very confusing thread.

My mum asked me if i could pick my grandma up from the airport. I asked if i had insurance. ( i couldnt check coz i was in leeds and my family lives in lincoln)

But you could of checked as you had to go to Lincoln to pick the car up yes?.
