I don't think this is about grit or the lack of grit, I think this is about the mental high that Laz was experiencing having recently exercised in the defendant's establishment.

Allow me to present exhibit A your honour...

This state of conciousness that the plaintiff was enduring at the time of the accident, which can only be described as closer to complete euphoria than if he hadn't been using the gym's machines, is the heart of this matter.

All these endorphins that were released upon his gym sanctioned use of the cross trainers and the pedal bikes were certainly a factor in this unfortunate incident. They brought about the aforementioned concentration inhibiting euphoria that was to blame for lazaroonie to lose his footing on that perilous walkway.

when do we take responsibility for our own actions?



When nobody else has an influence on them.

Laz was responsible for his action. The person who sprinkled a bit of grit on the path was responsible for his/hers.

Laz's action was to walk to his car. Because of someone making a bad job of gritting a path Laz's action could not be completed safely.

If the path was dangerous the gym should've been closed. Either that or they should make it safe.

They did neither hence they are liable. In my opinion of course. In court they may not be.

If you see a path that hasn't been gritted properly and yet decide to walk along it you choose to endanger yourself. If you freely decide to walk down an icy path and you slip over I don't see who's to blame but you. You could have gone back into the gym and complained and got them to sort it out. But you chose to walk down an icy path and you slipped over. That's it. You don't need to be Ray Mears to know if the path is slippy. I would like to add that the fact I'm the manager of a gym has no bearing on my opinions here.

what a load of crap. how do you propose that i got to my car if i didnt 'choose' to walk on the path ? when i arrived at the gym i was wearing trainers, with a more grippy sole, so did not notice that it was slippy. it is also possible that it had got colder in the two hours i was in there, and had become more frozen. also it was very poorly lit (still pretty dull here at 9am) and was difficult to see that it was icy.

Like I said I would propose that you get to your car by walking back into the gym and telling them you consider the path unsafe to walk on. I would also propose that you wear the more grippy shoes in your bag when walking down a potentially icy path, especially since the path has prob become more frozen over the last 2 hours as you suggest. My point is that if you chose to walk down a potentially icy path, and you did have a choice, and you chose to wear less appropriate footwear for the conditions, you may slip over. And you did. I would also say that people who can't rightly assess the ground around them should avoid walking about when it's icy and dark or they might slip over.
