On the listing it says that I can give refunds.

Do I have to give a refund if she requests for one?

Even though there is nothing wrong with the boots.

Can I say she has worn the boots therefore the boots are worthless now?

If your Ebay account is a business one you are legally obliged to accept returns, all covered within the Distance Selling Regulations.


Technically it should have been declared a 'business account' since the items were bought specifically to resell them. Distance Selling Regulations state that she has to declare her intention to return within 7 days of receipt of item. If they are worn, show signs of wear, then she's probably stuffed, you don't have to take them back.
Paypal is on her side, however, if she goes down that route it will be hard for you not to find yourself issuing a refund. She just has to say they were 'not as described'...then what do you do?

Maybe she got them, decided they didn't fit, now just wants her money back. :s ul

That was her first attempt. But I replied saying that I have used the description from the official H&M website. Oh well we will see what happens

tell her it's her fault for having short legs

and because she might have foot fungus,due to health and safety reasons you cannot offer a refund

you need to watch though, because paypal will freeze your account (or withdraw the money she paid if it is avalable) at the first sign of a dispute,  until the dispute is resolved.

really is just one of the many problems facing individuals masquerading as businesses (or should that be the other way around ?) on ebay.
