Apparently not if those rules are correct. At the end of the day his foot is extremely high, and according to the rules it should be a red. Probably not in British leagues and some consistency wouldn't hurt but it apparently intent/sight of a player doesn't matter. Manslaughter is a red not a yellow. (Horrible analogy but i have nothing else.)
