Lady Hale says the court is bound to conclude that the decision to advise Her Majesty was unlawful

Oo-er

Surefire resigning matter in normal circumstances.

These are not normal circumstances or a normal government though

further

No 10 had no explanation why it was proroguing for five weeks rather than the normal three to five days before a QS. Was indeed frustrating Parliament

armageddon avoided for government

"It is for parliament, speaker and lord speaker, to decide what to do next. Not clear to court that it is for PM to take any steps"

so further

Incredibly striking result on remedy. Not only is the court ordering the Government to get Parliament back. It is deciding that Parliament was never prorogued at all.

This means that all the bills dropped are not.
No Queen's Speech due
MPs can sit asap
Parliament returns in time to 9th September

Worth saying - this has never happened so Parliament is going to have to work out the procedures around it.

Major Constitutional scenes

Absolute cast iron 100% resignation matter. You can't get the Queen to do something unlawful, after all!

Totally agree with this, and yet I'm 99% certain it won't result in a resignation.

The logical step now would surely be for immediate VONC, which should now pass.  This should then give Corbyn first shot at forming a government, which would surely fail due to lack of support from opposition parties.  Alternative option would be to then install a short-term, cross party government headed by independent MP (thanks to Boris), Ken Clarke, which probably would get sufficient support to delay Brexit date.  Logically it should then stay in place to carry out a 2nd referendum, after which it can disband and hold a GE.  If 2nd ref votes for remain, it would have mandate to revoke Art 50 first, if 2nd ref votes to leave, then parties can campaign in GE for who should be mandated to negotiate terms of departure.

That's the hope for me anyway, but there's at least a clear pathway to a long-term solution via the above.  GE before referendum probably gets us back in a similar Parliamentary mess, as I doubt anyone can form a majority government short-term.

Agree Mr Johnson won’t resign, as he has no shame, and no one has the power to get rid of him.

The tories won’t get rid of him as most of their policies are not that popular, and they rely on name recognition of his to gain votes. Mr Johnson v Mr Farage and J wins, Farage v A N other and the tories are in a mess.

Ed Milliiband as leader of labour and there would be a VoNC and crushing win for labour, but with JC who makes Michael Foot look popular, labour won’t win.

I predict Mr Johnson will ignore the law and won’t send the request for extension, and ends up in jail for contempt of court, parliament votes for a new PM, there isn’t time to request an extension so revokes on Oct 30th.

Typhoon is right here, not sure why the journalists are making a thing of it.

1.24950 right now but broke 1.255 on Friday.
