Could you do what the man in SuperSize me did?
Eat nothing but McDonalds for a 30 days and eat everything on the menu at least once.
Didn't he nearly die?
Def
couldn't
do it. I have 5 McDonalds a
year
day, minimum.

A question for the great, knowledgeable people that view this thread....
A 58 year old recently started a job with me, it was clear from day one he was going to struggle but the employer sacked him 2 weeks into a 3 week training programme. Instead of offering him any extra support and instead of paying him for the 2 weeks work he done, they have deducted £400 from his wage for training costs and paid him only £20. Legally is this allowed?
I would say he has a case for
1. Wrongful deduction of wages
and
2. Age discrimination

I would say he has a case for
1. Wrongful deduction of wages
and
2. Age discrimination
1. You can deduct from wages if you had signed authorisation to do so before the reason for the deduction occurred.
2. I don't agree with this, you would do if you used his age as a reason to not give him the job, but the correct thing to do is to employee him and then let him go if he is not capable.

1. You can, but I would argue that the training provided was both incomplete and ineffective, and for all intense and purposes non-existent.
2. Vinny infers that he was struggling was age related, and because no support was provided to help him overcome his issues then its age discrimination.
If I was his boss, I would be dreading a letter from the guys solicitor, and looking at ways of tightening up my recruitment processes.

1. If your going to argue like that then surely it is very dependent on what the training is? In house then yes your right, course days that he was struggling to keep up with maybe not.
2. Are capability issues that easily passed off as age discrimination these days? I haven't had any age discrimination issues to deal with as yet.
What was the job?

They would also have to prove that the cost of training was £400.
Can't just deduct a random amount.

I haven't had any age discrimination issues to deal with as yet.
because you cleverly avoid these problems by not employing anyone over 30

As with most of these cases, the employer is guilty until proved innocent; and even when they have a good case, they would rather settle than go to an ET.
In my experience, most people want to do a good job and will listen when this is pointed out to them. If they find it impossible to improve and you have made every effort to help them, then you are both aware of the next step.

Still 22 days to go til Vegas
Not wanting to wish my life away, but hurry the fk up please 20 June.
Home early from Luton, more on that later, Have checked, re-checked, and checked again. My passport is ok, it runs out in 2014. Just done my ESTA too, and the daft buggers accepted my application.
Sicilidonk has agreed to upgrade us into the Venetian if he has a decent bink between now and then, so, for once, I'm hoping he does well.
He is currently in the last 16 at Luton, and is giving updates via MSN, was doing well til he decided to shove from the sb, and the BB called with kinngs
Still has average chips.
Come on son... the Venetian upgrade is relying on you!

Another long weekend, seems like we have had loads of them recently.
My dad is away in Malta until Tuesday. He went over to vote on the referendum on divorce.
The Maltese government give Maltese nationals living abroad a heavily subsidised flight (He paid £20) to fly back, so they can vote.
I'm sure there is a more cost effective way of doing it.
